Can an NRI file for divorce in India without returning? +
Yes. In many cases, NRIs can initiate and proceed with divorce proceedings in India without being physically present for every hearing. Which Indian court has jurisdiction over an NRI divorce? +
Jurisdiction is typically determined by where the marriage was solemnized, where the couple last resided together in India, or where the respondent currently resides. Our team assesses the most advantageous jurisdiction for your case based on these factors.
Is a foreign divorce decree valid in India? +
A foreign divorce decree may be recognised in India if both parties were domiciled in the foreign country, had genuine connection to that jurisdiction, and the decree was not obtained by fraud. However, Indian courts may not automatically recognise all foreign decrees. We advise on recognition, enforcement, and any supplementary Indian proceedings needed.
How long does an NRI divorce case take in India? +
